iPhone jailbreaking refers to the practice of “hacking” your iPhone (or iPod Touch/iPad etc) in order to get away from some of the restrictions that Apple puts on the device. When your iDevice comes from the factory, it’s capable of more than Apple wants to admit. They turn off some features in order to “preserve the user experience”. But why should Apple dictate what you can do with your device? You paid for it after all…

Installing Unauthorized 3rd Party Apps

Apple has a strict review process in place for apps that get into the official app store. Apps are often banned from the app store for reasons that many of us wouldn’t agree with. For instance, Apple bans apps that allow you to customize or modify your iPhone. They want everyone’s iOS and homescreen to look pretty much the same, and they don’t want you to change it. Furthermore, Apple often doesn’t allow apps that make a political statement which Apple doesn’t agree with (read: Apple engages in censorship). Apps that solicit contributions for charitable organizations are another example of a category that is banned.

What Is iPhone Unlocking?

So now let’s turn our attention to iPhone unlocking. Many people use the terms “jailbreak” and “unlock” interchangeably. However, they are two very different procedures, which grant you the ability to do different things.

When you purchase an iPhone, it is SIM locked to a certain carrier. This means that you can ONLY use your iPhone with that carrier. Up until this year, AT&T was the only carrier in the US with which you could use an iPhone. With the release of the iPhone 4, Apple also started selling phones which were locked to Sprint or Verizon. So consumers have a little more choice now by default, but still not as much choice as they SHOULD have.

When you unlock your iPhone or iPad (unlocking doesn’t really apply to the iPod Touch), you can then use your device with any carrier that you choose, as long as the carrier is GSM based. (See here for a list of global GSM carriers).

The process of unlocking can be a little more complicated than that of jailbreaking, but with instructions and support such as ours, it’s still easily within the reach of the average person.

Using the Device on the Carrier of Your Choice

As we said above, once you unlock, you can use your phone on any GSM carrier’s network that you choose. So if you find a carrier that offers a lower priced plan or has better service in your area, you’re golden.

This is a bit of a corollary to the point above. But think about it. When you travel overseas, you’re stuck either 1)Paying exhorbitant roaming charges to make calls 2)Buying an expensive pay as you go phone in each country that you visit or 3)Trying to use Skype over flaky Wi-Fi to make your calls. When you unlock your iPhone, you can simply insert a SIM card from a GSM network that is local to the country that you’re in, and voila – you can make calls at local rates with your own iPhone.

Is Jailbreaking/Unlocking Legal?

Apple says “No”. The United States government says “Yes”. In many other countries, it’s a grey area. When the original iPhone 2G was first jailbroken in 2007, Apple was furious. They threatened to prosecute anyone who did a jailbreak on their phones, saying that it was a copyright violation. Thankfully, as we stated above, there was no way for them to know who had a jailbroken phone, and no prosecutions ever occurred. Then, in 2008, the Electronic Frontiers Foundation filed a suit with the US copyright office and the US Library of Congress to get a “Fair Use” DMCA exemption granted to effectively legalize jailbreaking. Apple protested, but in a ruling made in July of 2010, the US Government sided with consumers, ruling that jailbreaking and unlocking iPhones was indeed “fair use” and did not have the effect of violating Apple’s copyrights. Apple still insists that the practice should be illegal. Lucky for us, however, Apple does not have a police force or jails in which to incarcerate people. In Europe, there has no been no ruling saying unequivocally that jailbreaking is legal, as there was in the United States. However, most people interpret this EU directive to grant the same type of “fair use’ exemption as exists in the US. Furthermore, no prosecutions have ever occurred in Europe.

In the rest of world, laws vary greatly, so we can’t make any definitive statements. However, we’re unaware of any country in which jailbreaking or unlocking has been specifically outlawed, and this applies to the upcoming ability to jailbreak 6.0.1.
